Customs Brokerage Services – Customs Broker: Circular No. 12/2015/TT-BTC stipulates that a customs broker is an enterprise that fully satisfies the conditions prescribed in Clause 1, Article 20 of the Law on Customs.

A customs broker acts on behalf of the owner of exported or imported goods (hereinafter referred to as the cargo owner) to carry out customs declarations; submit and present customs documents related to import and export shipments in accordance with regulations; and perform all or part of the customs procedures as agreed in the contract signed with the cargo owner.

Clause 1, Article 20 of the Law on Customs stipulates the conditions for acting as a customs broker:

a) Having a Business Registration Certificate or Enterprise Registration Certificate covering freight forwarding services or customs brokerage services;
b) Having qualified customs brokerage staff;
c) Having information technology infrastructure that meets the requirements for electronic customs declaration and other applicable conditions as prescribed.
